As one of the judges in the Court of Appeal pointed out, the interpretation so given results in unfairness. It is unjust that if insurance companies agree to insure a party to the extent of a sum in excess of the statutory minimum and collect premiums based on that sum, it is unjust to require the companies to pay over to the injured party, only the minimum coverage required by the statute.
